Footstep’s may, at its sole discretion, require you to submit any disputes arising from these Terms, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association, applying New York law.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
Any claim relating to the Site or these Terms must be brought within one (1) year after the claim arises, or it will be permanently barred.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Failure by Footsteps to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
